API Terms of Service

1. API License

Subject to your compliance with these API Terms and the general Terms of Service, ProbIntel grants you a limited, non-exclusive, non-transferable, revocable license to access and use our APIs solely for the purpose of developing, testing, and operating your applications.

2. API Key Security

You are responsible for maintaining the confidentiality of your API keys. You agree to:

• Keep your API keys secure and confidential
• Never share API keys in public repositories or client-side code
• Immediately notify us if you suspect unauthorized use
• Rotate keys periodically as a security best practice

3. Rate Limits

API access is subject to rate limits based on your subscription plan:

Exceeding rate limits may result in temporary throttling or suspension.

4. Acceptable Use

You agree NOT to:

• Use the API for any illegal purpose or to violate any laws
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with or disrupt the integrity of the API
• Attempt to circumvent rate limits or access controls
• Use the API to build a competing product or service
• Redistribute or resell raw API data without authorization
• Use automated systems to scrape or harvest data beyond your plan limits

5. Data Use Restrictions

Data obtained through the API may be used to:

• Display in your applications for end users
• Power internal analytics and decision-making
• Create derivative insights and visualizations

Data may NOT be:

• Cached or stored beyond your plan's retention limits
• Sold or provided to third parties as raw data
• Used to train machine learning models for resale

6. Attribution

If you display ProbIntel data publicly, we appreciate (but do not require) attribution such as "Data by ProbIntel" with a link to probintel.com.

7. Uptime and SLA

We target 99.9% uptime for API availability. Enterprise plans include custom SLA agreements with guaranteed uptime and support response times. See your enterprise agreement for specific terms.

Scheduled maintenance windows will be announced at least 24 hours in advance via our status page and email.

8. API Changes

We may modify, deprecate, or discontinue API endpoints with notice:

• Minor changes: Immediate effect
• Breaking changes: 30 days notice minimum
• Deprecations: 90 days notice minimum

We will communicate changes via our developer changelog and email.

9. No Warranties & Disclaimer

THE API AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

PROBINTEL EXPLICITLY DISCLAIMS:

• Any guarantee of accuracy, completeness, timeliness, or reliability of data
• Any warranty that the API will be uninterrupted, secure, or error-free
• Any warranty regarding the results obtained from using the API
• All implied warranties of merchantability, fitness for a particular purpose, and non-infringement

PREDICTION MARKET DATA IS SPECULATIVE. USE OF API DATA FOR TRADING OR INVESTMENT DECISIONS IS ENTIRELY AT YOUR OWN RISK. YOU ASSUME FULL RESPONSIBILITY FOR ANY LOSSES INCURRED.

10. Zero Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBINTEL SHALL HAVE ZERO LIABILITY FOR:

• Financial losses or trading losses based on API data
• Inaccurate, delayed, or missing data
• API downtime, interruptions, or rate limit enforcement
• Data breaches, unauthorized access, or security incidents
• Third-party platform changes (Polymarket, Kalshi, etc.)
• Any direct, indirect, incidental, consequential, or punitive damages

AGGREGATE LIABILITY CAP: ProbIntel's total liability under these API Terms shall not exceed the lesser of: (a) fees you paid in the prior 3 months, or (b) $50 USD.

11. Termination

We may suspend or terminate API access immediately, without notice or liability, for:

• Violation of these terms
• Non-payment of fees
• Abusive usage patterns or attempts to circumvent rate limits
• Legal or regulatory requirements
• Any reason or no reason in our sole discretion

Upon termination, you must immediately cease all API use, delete all API keys, and destroy any cached data. No refunds will be provided.

12. Governing Law

These API Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes are subject to the arbitration and dispute resolution provisions in the general Terms of Service.
